Please read these Terms of Service ("Terms") carefully before using the FlowState mobile application, website, or any services offered by FlowState LLC ("FlowState," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

 

1. About FlowState

FlowState LLC is a wellness company incorporated in the State of Ohio that provides breathwork, sound bath, and nervous system regulation content through its mobile application and website (myflowstate.life). FlowState also offers live sessions and events for members.

 

2. Eligibility

You must be at least 18 years of age to use our services. By agreeing to these Terms, you represent and warrant that you are of legal age and have the authority to enter into a binding agreement. FlowState is not intended for use by minors.

3. Membership & Access

3.1 Membership

FlowState offers a paid membership that provides access to the mobile application, digital content library, and live sessions and events. Membership is personal and non-transferable.

3.2 Account Registration

To access membership benefits, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use at support@myflowstate.life.

3.3 Subscription Billing

Membership fees are billed on a recurring basis (monthly or annually, depending on the plan selected). By enrolling, you authorize FlowState to charge your payment method on the applicable billing cycle.

4. Cancellation & Refund Policy

You may cancel your membership at any time. Cancellation takes effect at the end of your current billing cycle, and you will retain access to membership benefits through that date. FlowState does not offer refunds for any unused portion of a billing period, including partial months or unused event access.

To cancel, you may do so through your account settings in the app or by contacting us at paul@myflowstate.life.

5. Live Sessions & Events

FlowState membership may include access to live virtual or in-person sessions and events. Availability, scheduling, and format of live events are subject to change at FlowState’s discretion. FlowState does not guarantee a minimum number of live events per billing period. No refunds will be issued for missed or rescheduled events.

6. Health & Wellness Disclaimer

The content, guidance, and practices offered through FlowState — including breathwork, sound bath, and nervous system regulation techniques — are intended for general wellness purposes only. They are not medical advice and are not a substitute for professional medical, mental health, or therapeutic care.

By using FlowState services, you acknowledge that:

• Breathwork and somatic practices may produce strong physical or emotional responses.

• You are responsible for assessing your own physical and mental readiness before participating.

• FlowState strongly recommends consulting a qualified healthcare provider before beginning any breathwork or wellness program, especially if you have a medical or mental health condition.

A separate liability waiver will be presented during onboarding and must be acknowledged prior to accessing breathwork content.

 

 

7. Intellectual Property

All content on the FlowState platform — including but not limited to audio, video, guided sessions, curriculum materials, and branding — is owned by or licensed to FlowState LLC and protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any FlowState content without express written permission.

8. Prohibited Conduct

You agree not to:

• Share your account credentials or allow others to access your membership.

• Record, download, or redistribute FlowState content without written authorization.

• Use the platform for any unlawful, harmful, or disruptive purpose.

• Misrepresent your identity or qualifications within the FlowState community.

9. Limitation of Liability

To the fullest extent permitted by Ohio law, FlowState LLC, its owners, facilitators, employees, and contractors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use our services, including any physical, emotional, or psychological responses to wellness practices.

FlowState’s total liability for any claim arising under these Terms shall not exceed the amount you paid in the three (3) months prior to the claim.

10. Indemnification

You agree to indemnify and hold harmless FlowState LLC and its officers, facilitators, and agents from any claims, damages, or expenses (including reasonable attorney’s fees) arising from your use of the services, your violation of these Terms, or your violation of any third-party rights.

11. Modifications to Terms

FlowState reserves the right to update these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the services after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Ohio.
